Lawmakers and families have called on Chicco U.S.A. to recall its Lullaby Dream Playard, alleging serious safety concerns and the death of at least one infant in the lullaby dream napper.

Chicco Playard Lawsuit Filed Against Manufacturer

The first Chicco Playard lawsuit was filed in September of 2019.

WPVI-TV Philadelphia reported:

  • Lakin Harmon, a Pennsylvania mother, is suing Chicco U.S.A. after she claims her 3-month-old baby died in what she calls a defective product that is still on store shelves…
  • But on May 3, 2017, the unimaginable happened. Lakin said that Cayson’s dad, Jayme, put their son down for about 30 minutes in the Chicco infant napper…
  • Cayson died that day at just three months old.
  • The inclined napper comes with Chicco’s Lullaby Dream Portable Playard.
  • In a lawsuit, Cayson’s parents allege the product is defective and dangerous and caused their son’s death.

The Harmon family’s lawsuit against Chicco U.S.A. is consistent with thousands of baby sleeper recall lawsuits across the country.

The family’s attorney noted that the Playard’s design puts infants’ heads at an incline and can lead to suffocation.

This design flaw has led to hundreds of thousands of recalled sleepers by the US Consumer Product Safety Commission.

In March of 2020, lawmakers called on Chicco U.S.A. to consider recalling its products.

Chicco Playard Recall

A House of Representatives committee asked Chicco U.S.A. to consider recalling its Lullaby Playard in March 2020.

USA Today reported that Rep. Carolyn Maloney, D-N.Y., chairwoman of the House Oversight and Reform Committee, asked Chicco to provide further safety information about the company’s products, citing serious concerns about numerous deaths tied to infant incline sleepers.

Maloney’s letter to Chicco notes there is no discussion in the marketing materials or on the website about whether the Newborn Lounger, which was previously called Newborn Napper, is appropriate for newborn sleep despite its incline.

Maloney notes that it is not until page 29 of the Lullaby Baby Product Manual that the following warning appears:

“NEVER leave child unattended. You are responsible to provide adult supervision when using your napper.”

As of May 2020, the Chicco Playard has not been recalled.

The Chicco U.S.A. website’s safety recall page only mentions a Chicco Polly Highchair Recall.

Maloney and other lawmakers have noted that the continuous sale of incline sleepers – and the regulatory and internal processes for introducing new products for infants — puts newborns at risk of death or serious injuries.

Chicco Playard Injuries and Fatalities

The Consumer Product Safety Commission (CPSC) has concluded that infant incline sleeper products, such as the Chicco Playard Lullaby, are not safe.

CPSC conducted studies on baby sleeper products because of a concerning number of associated injuries and fatalities.

The design of these products positions infants at a 10 to 30-degree incline, making it easier for them to roll over onto their stomachs.

This puts them at risk for:

  • Suffocation
  • Neck Injuries
  • Sudden Unexpected Infant Deaths (SUID)
  • Sudden Infant Death Syndrome (SIDS)
  • Abdominal Injuries
  • Other injuries/complications from restricted breathing, abdominal / neck muscle overexertion, or falls

CPSC proposed that all inclined sleep products with an incline above 10 degrees be removed from the market.

The Chicco Playard remains on the market as of May 2020.
