TorHoerman Law is proud to share that our partner, Jake Plattenberger, was featured in a recent New York Times article examining the appointment of Kyle Diamantas to lead the Food and Drug Administration’s food division.

The article highlights the concerning background of Diamantas, who, now responsible for regulating infant formula safety, previously represented Abbott in lawsuits alleging the company failed to warn parents about risks associated with their specialized formula for premature infants.

Jake Plattenberger Featured in New York Times Article on FDA Appointment

In the Gill v. Abbott NEC Lawsuit case highlighted in the article, our team, led by Plattenberger, represented the family whose child developed necrotizing enterocolitis (NEC) after being fed Abbott’s formula, resulting in life-altering bowel and brain damage.

During the trial, the TorHoerman Law team presented internal Abbott documents confirming that infant formula “is thought to be a contributing factor to the development of NEC.”

The evidence uncovered showed that about 90 percent of preterm infants who developed this condition had been fed formula, and studies demonstrated formula feeding increases the risk of NEC by 180 percent.

The jury sided with Ms. Gill, awarding a $495 million verdict.

Diamantas’s appointment raises serious ethical concerns about potential conflicts of interest, considering his previous role defending Abbott.

Our firm, along with others, share legitimate questions about whether someone who recently defended a corporation against safety claims can now objectively regulate that same industry with consumer protection as the priority.
